plus police say three teenagers were bored so they decided to cale college student for fun. >> it was well thought out. >> something -- >> >> shepard: we will hear from the mother of one of the suspects. and high school students claim they are uncovered an oreo ripoff. >> it looks like the stuffing on the double stuff is slightly less than a real double stuff oreo. >> double stuff is less than oreo. >> tonight the cookie company responds. but first from fox this tuesday night. a 21-year-old intern at bank of america collapsed and died after he reportedly worked three back-to-back shifts of nearly 24 hours each. that is 72 hours of work with very little break and we're already seeing fallout from his death that could effect other interns.

more on that in a moment. first, this happened at bank of america's office in london. multiple reports indicate the intern was a former undergrad exchange student at michigan's raw school of business. he was from germany, just a week shy of finishing that summer internship program. a fellow intern reportedly described him as a super star who worked very hard but last week a roommate found him dead in the shower. bank of america released this statement. he was popular amongst his peers and highly diligent intern at our company with a promising future. our first thoughts are business w. his family and we send our condolences to them at this differ time. a spokesperson for bank of america says the coroner is investigating the cause of death but police and bank officials say therey no suspicious circumstances surrounding the death folk business network charlie gasparino joins us. >> i'm sure you pulled a few all nighters and a few in my day this gentleman

pulled about three all nighters before he was found dead. here is the interesting thing we have been talking at the fox business network to other firms, bank of america inside these firms. what we do get now is affirmation that these firms are rethinking this sort of policy. unwritten policy. kind of like a hazing policy where interns have to work around the clock. obviously they are not telling people to work 72 hours without sleep but there is nothing telling them not to. that's what we have right now. at least we know at goldman sachs, they are, sources tell us rethinking this policy and could have pretty big implications. >> shepard: did they pay him. >> they don't pay him by the hour. i know that. they do pay these interns. i will say, this they do pay them. they pay as much as $100,000 a year. that's nothing to sneeze at. it's not worth your life when you are working around the clock. >> shepard: nothing is. charlie, don't tell our interns about that pay either. thank you. here at home a former unpaid inturn p diddy's record label is now reportedly suing that

company for violating minimum wage laws according to tmz and "new york post." the company claims the company made her answer telephones, get lunch and coffee for paid employees even decorate the office during the holidays. we reached out to the label. no comment yet. well now the cold blooded killing in oklahoma where a sheriff, or a local police chief, really, reports the motive was bother dom. he claims three teenage boys couldn't think of anything to do. so, for the fun of it as they put it, they killed someone, they appeared today in court where prosecutors charged them with first degree murder and ordered them held without bail. a third faces charges he was an accessory after the fact. yet, get. this he announced in court that he actually pulled the trigger. cops say the boys drove up behind a random jogger in an a affluent neighborhood and shot him in the back 3:00 in the middle of the afternoon. ha random jogger is a young man though ho came a long way to meet such a cruel

end. >> lost something that never going to be replaced. it takes a village to raise a kid. chris was a product of a fantastic village. >> that village is australia. people laid flowers on a baseball field where he used to play. he played well enough to earn a scholarship to attend east oklahoma central university where he was just about to start his senior year. >> was well thought of, was well liked. of course, being australian he had an accident that drew people to him. just to have a conversation with him. >> shepard: there was apparently no conversation last friday with the teens who allegedly attacked him. investigators report they drove behind lane as he jogged down this road, then shot him in the back. according to the police chief, one of the kids later confessed saying: we were bored and didn't have anything to do. so so we decided to kill somebody. >> and their perception,

bad attention is better than no attention at all. >> i know in my heart that he did not pull that trigger. >> shepard: one of the suspects' mothers defended the son outside the courthouse. she admits he was part of a wanna be gang. if he was there he needs to be punished. the town where the shooting happened is about 85 miles from christopher lane's college. he was there visiting his girlfriend they tell us. back in australia, his old baseball team has scheduled a memorial game to raise funds for his parents as they work to bring his body home. and australian politician is calling for a boycott of united states tourism in protest, he says, of america's gun policies. a teenager sneaks into an elementary school today with an assault rifle in his hands and opened fire. hundreds of children running for cover. but now police say nobody got hurt and that suspect is under arrest. happened this afternoon outside atlanta. police say visitors

normally have to get bused into the school but this suspect got inside by following somebody else through one of the doors. they said he had had no ties to the school at all not a friend not a relative. the teen fired six shots and officers returned fire. in the meantime teachers and staffers had to evacuate some 800 kids leading them to a field before a school bus or a series of them really took them to a wal-mart parking lot to reunite with their parents. we have been here since 1:30 waiting on the kids. he just got off the bus, too. >> shepard: police say the suspect may have also been carrying explosives in the trunk of his car as i mentioned he is in police custody. word that all of the children are safe. the state department reports it has cleared four officials in the benghazi investigation. and we'll give them new jobs. republicans are blasting the move. one congressman calls the

state department's investigation a charade. the department put four officials on leave last year after a review board blamed systemic failures for the attack on outpost in libya. the attack killed the american ambassador chris stevens. state department officer sean smith and two navy seals tyrone woods and glen doherty. james rosen is live at the state department tonight. james? >> all four of these employees are career officials. the highest ranking was eric boswell the assistant secretary of state for diplomatic security or ds. he had resigned his post. scott was a senior ds official. charlene lamb was boswell's deputy and raymond maxwell worked in the nearest bureau. in january then secretary of state hillary clinton told the senate existing law prevented her from taking stronger action against the four. but her successor john kerry took a different view what the secretary and his team has been doing is doing more fact-finding going into what happened on the ground and also looking at the totality of these

years old. emotional survivors of a massacre in afghanistan are confronting the soldier who murdered their loved ones. one of them so shaken he started crying and got up to leave court. this is the killer. staff sergeant robert bales. he pleaded guilty to slaughtering 16 villagers in afghanistan last year. most of the victims helpless women and children. families who lived in homes made of mud. it happened while sergeant bales was on his fourth tour in afghanistan. slipped from the base. drinking taking steroids and snorting valium. he shot victims with pistol and assault rifle. he went back to his base only to go out later and attack a second village. the military flew over several survivors for that sentencing phase that started today. some of them have faced the killer in court. a 12-year-old boy talked about crying after bales shot him in the ear. another man testified that bales shot him in the jaw and also shot his children.

during questioning, a man broke down and said through a translator please, god, don't ask me anymore questions. dan springer with the news live in washington state. dan. >> that 6-year-old afghan who talked about being shot in the jaw and two children being shot also at one point speaking through interpreter called sergeant robert bales a bastard who had changed his life forever. all of the witnesses today afghanistan spoke about bales going methodically going room to room shooting men women and children and old men. we are only children. what have we done to you? earlier today the government argued bales should never be free again, describing the atrocity in cold detail. the prosecution said he hated afghans and called them quote muzzies. said he was angry about not getting a promotion and resented his superiors for not being more aggressive towards the locals. just moments ago the prosecution played a tape recording of a conversation between bales and his wife in 2012 in which he is

heard laughing about the 16 counts of murder against him. as part of the plea deal bales admitted he knew what he was doing that night and he knew it was wrong. the government needs five of the six jurors to agree that bales should never be free again. otherwise, he could be eligible for parole in 20 years. shep? >> another interesting angle of this case a drug that the killer took while stationed overseas. the drug is antimalaria medication which the military routinely gives to soldiers. according to federal health officials that drug can cause psychotic side effects which could be permanent. an attorney for sergeant bales says his client took that medicine while in iraq medical records from afghanistan are incomplete. the prosecution's case has rested against the admitted footed shooter. now major nidal hasan could take the stand. and in a bizarre twist. the person asking the questions would be accused of -- the accused killer himself. in other words, the major would question himself and
